Terms and Conditions

Luxury Assisted Travel: Terms & Conditions and Liability Waiver

Effective Date: 25th May 2026

1. Overview

Luxury Assisted Travel (“we”, “us”, “our”) provides curated travel experiences with various levels of personal care and support. These Terms and Conditions (“Terms”) govern your participation in our travel services. By booking a service with us, you (“the client”, “you”, “your”) agree to abide by these Terms and acknowledge the Liability Waiver herein.


2. Booking & Payment Terms


2.1 Booking Confirmation

All bookings must be confirmed with a signed agreement and payment of a non-refundable deposit. Full payment is required [e.g., 60 days] before departure.


2.2 Payment Methods

We accept electronic bank transfer, credit card, and approved third-party finance providers. All payments must be in AUD unless otherwise agreed in writing.


2.3 Pricing:  All prices are per person unless otherwise stated and are subject to change based on availability, supplier adjustments, taxes, or currency fluctuations.


3. Cancellation & Refund Policy

  • Client Cancellation
     
    • More than 60 days prior: Refund minus deposit
       
    • 31–60 days prior: 50% refund
       
    • 0–30 days prior: No refund
       
  • Service Cancellation by Us
    We reserve the right to cancel a service due to unforeseen circumstances, including but not limited to insufficient bookings, force majeure, or safety concerns. In such cases, you will receive a full refund or alternative trip credit.
     

4. Care Packages & Medical Services

Luxury Assisted Travel provides Silver, Gold, and Platinum Care Packages offering varying levels of support, from basic mobility assistance to medical coordination.


4.1 Medical Disclosures

You must disclose all relevant medical conditions, disabilities, and medications at the time of booking. Failure to do so may result in cancellation of your booking without refund.


4.2 Medical Supervision

Our staff are not licensed to provide emergency medical care. If you require ongoing medical supervision, this must be clearly indicated and may necessitate the Platinum Package or a private registered nurse.


5. Travel Insurance

Comprehensive travel insurance (including medical, cancellation, and repatriation coverage) is mandatory for all clients. Proof must be provided prior to travel.


6. Responsibility & Conduct

Clients are expected to behave respectfully and in accordance with local laws, cruise or hotel policies, and the guidance of care staff. We reserve the right to refuse service or remove any person behaving disruptively or posing a risk to themselves or others.


7. Limitations of Liability

Luxury Assisted Travel acts as an intermediary between clients and suppliers (e.g., cruise lines, airlines, hotels). While we take reasonable care in selecting partners, we do not accept liability for:

  • Injury, loss, or damage caused by third parties
     
  • Delays or changes in travel due to weather, strikes, or mechanical failure
     
  • Medical issues not directly caused by our staff or services
     

8. Liability Waiver

By booking with Luxury Assisted Travel, you voluntarily assume all risks associated with travel and participation in activities. You hereby release, indemnify, and hold harmless Luxury Assisted Travel, its directors, employees, contractors, and agents from any and all claims, liabilities, damages, or costs (including legal fees) arising from:

  • Personal injury, illness, or death
     
  • Property loss or damage
     
  • Delays, cancellations, or service interruptions
     
  • Acts or omissions of third-party providers
     

9. Changes to Terms

We reserve the right to update these Terms at any time. Updated versions will be published on our website and apply to future bookings.


10. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under or in connection with this agreement will be subject to the exclusive jurisdiction of Queensland courts.


11. Acceptance

  1. By proceeding with your booking, you acknowledge that you have read, understood, and agree to these Terms & Conditions and the Liability Waiver.
